Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the websites, dashboard, APIs and proxy services (collectively, the “Service”) operated by HelloProxies (“HelloProxies”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

HelloProxies rents access to dedicated 4G/5G mobile proxy endpoints. Each subscription is backed by physical modem hardware and a mobile carrier SIM operated by us and assigned to a single customer for the duration of the subscription. The Service includes proxy endpoints (HTTP, SOCKS5 and, where available, OpenVPN), a management dashboard, IP rotation functionality and a developer API.

IP addresses are assigned dynamically by the underlying mobile carrier. We do not guarantee any specific IP address, IP range, geographic granularity beyond what is described at purchase, or the behavior of third-party websites and platforms accessed through the Service.

2. Accounts and eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials and API keys, and for all activity that occurs under your account. Notify us immediately at support@helloproxies.com if you suspect unauthorized use of your account.

We may require identity verification (KYC) before or during service for customers or usage patterns we deem higher risk. Failure to complete requested verification may result in suspension or termination.

3. Payment, renewals and wallet

Fees are stated at checkout and charged in advance for each billing period. We accept card payments (processed by Stripe), supported cryptocurrencies and prepaid wallet balance. Unless auto-renewal is disabled in your dashboard before the end of the current period, subscriptions renew automatically and the renewal fee is charged to your selected payment method or wallet balance.

Wallet balances are prepaid credits for use within the Service. Cryptocurrency payments are credited after network confirmation. All fees are exclusive of any applicable taxes, which are your responsibility. Failure to pay renewal fees results in suspension and, after a grace period, release of your assigned hardware.

4. Fair use

Bandwidth is unmetered, but the Service runs on shared carrier radio infrastructure. Sustained usage patterns that degrade the carrier network, trigger carrier enforcement, or materially differ from ordinary business usage may be rate-limited after notice where practical. We reserve the right to take immediate action where required to protect the network or comply with carrier obligations.

5. Prohibited conduct

You may use the Service only for lawful purposes. Prohibited uses are set out in our Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you must not use the Service for illegal activity, unauthorized access, fraud, spam, credential stuffing, fake engagement, ban evasion or any activity that violates applicable law. Violations may result in immediate suspension or termination without refund.

6. Service availability

We operate physical radio hardware on a third-party mobile network. While we engineer for high availability, the Service is provided “as is” and we do not guarantee uninterrupted operation, specific speeds, or the continued availability of any particular carrier, band or location. Scheduled maintenance will be announced where practical. Hardware faults are addressed under our Refund Policy.

7. Suspension and termination

We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms or the Acceptable Use Policy, if your payment fails, if we receive a credible abuse complaint or legal demand concerning your usage, or if continued service would expose us or our carrier partners to legal or operational risk. You may stop using the Service and cancel renewals at any time from your dashboard.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We are not responsible for the actions of third-party websites, platforms or networks, including any blocking, rate-limiting or account actions they apply to traffic originating from the Service.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

9. Indemnification

You agree to indemnify and hold harmless HelloProxies, its operators and suppliers from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, your content or traffic, or your breach of these Terms or the Acceptable Use Policy.

10. Governing law and changes

These Terms are governed by the laws of the jurisdiction in which HelloProxies is established, without regard to conflict-of-law rules; the specific venue and governing jurisdiction are stated on your invoice or order confirmation. We may update these Terms from time to time. Material changes will be announced via the dashboard or email, and the “Last updated” date above will be revised. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
